Trading in cryptocurrencies (such as Bitcoin, Ether, Dash, Ripple, Monero, and many others) has brought considerable profits to many investors. But the belief that digital currencies offer anonymity is a dangerous fallacy. German tax authorities have upgraded their technology and are systematically targeting crypto investors. Profits from trading Bitcoin and other cryptocurrencies are taxable —and anyone who fails to report them is committing tax evasion.

Frequently Asked Questions About Cryptocurrency and Taxes
When are gains from cryptocurrencies tax-free? Gains are tax-free if more than one year has elapsed between the purchase and sale of the respective coins (the so-called holding period). Under certain circumstances (e.g., staking), this period may be extended to ten years. A thorough review is essential.
How does the tax office find out about my crypto transactions?Tax authorities can submit requests for information to trading platforms. In addition, they sometimes purchase data from analytics firms that track the blockchain. Banks are also required to file reports of suspected money laundering when they receive large sums of money from exchanges.
What happens if I simply don't report my earnings? This constitutes tax evasion. The risks include back taxes for up to 10 years, high interest rates (6% per year), fines, and, in the worst case, a prison sentence.
Can I file a voluntary disclosure on my own? This is strongly discouraged. A voluntary disclosure is only valid if it is absolutely complete and accurate. Even the smallest errors or omissions render it invalid, with the result that you incriminate yourself and are even more likely to trigger criminal prosecution.

A voluntary disclosure is only effective as long as the offense has not yet been discovered and you have not yet been notified that an investigation has been initiated. If criminal proceedings are initiated, it is important to mount a defense as early as possible.
